MDConsult is a clinical decision support tool, not a Software as a Medical Device (SaMD), and has not been reviewed or cleared by the FDA. It generates educational lens category information to inform, not replace, your independent clinical judgment. Patient-facing outputs are educational only and do not constitute a lens or surgical recommendation.

You retain full clinical authority and responsibility for all treatment decisions. MDConsult outputs are one input among many and must be interpreted alongside your comprehensive examination, diagnostic data, and clinical judgment. No output should be communicated to a patient as a clinical recommendation, diagnosis, or preferred treatment plan.

Patient data is transmitted and stored using HIPAA-compliant infrastructure, including encryption in transit and at rest, access controls, and audit logging. A Business Associate Agreement (BAA) is available upon request. Patient authorization for data collection and use is obtained directly by MDConsult through a separate patient-facing consent process prior to any data submission.

MD Consult AI LLC may collect and analyze aggregated, de-identified platform usage data, including surgeon-level metrics such as consultation volumes, lens category selection patterns, and patient upgrade rates, to improve the platform, support research, and demonstrate product effectiveness. This data does not identify individual patients and is not subject to separate consent requirements.

With separate patient consent, de-identified data may be used by MD Consult AI LLC for research, platform improvement, and quality analysis. De-identification is performed per HIPAA Safe Harbor or Expert Determination standards. MD Consult AI LLC reserves the right to update data use practices; material changes will be communicated to active users in advance.

MD Consult AI LLC makes no warranty regarding the accuracy, completeness, or fitness for purpose of any platform output, and expressly disclaims liability for any clinical outcome, patient dissatisfaction, or adverse event arising from use of or reliance on MDConsult. To the fullest extent permitted by law, MD Consult AI LLC is not liable for indirect, incidental, or consequential damages arising from your use of this platform.

By activating your MDConsult account, you confirm that you are a licensed ophthalmologist or qualified healthcare professional; that you have read and agree to these terms; that you will use MDConsult solely as a decision support tool consistent with your professional obligations; and that you have independently evaluated its suitability for your practice and are not relying on any representation by MD Consult AI LLC regarding regulatory status or clinical efficacy.
